This Acceptable Use Policy (“AUP”) applies to use of Nicholson Solutions software and services, including DocGymOps, CheknOps, GuardReady Ops, approved bundles, public or kiosk interfaces, APIs or server functions made available to Customer, and related hosted services. It supplements the Software License & Service Agreement and applicable Order.

2. Authorized business use

Customer and its users may use the services only for lawful internal business purposes within the purchased product, site, location, account, and user scope. Customer is responsible for its users and administrators and must maintain reasonable account and device security.

3. Prohibited unlawful or harmful use

Customer may not use the services to:

  • violate applicable law, court order, or another person’s legal rights;
  • harass, threaten, stalk, discriminate unlawfully, defraud, impersonate, or surveil a person unlawfully;
  • collect, store, or disclose information Customer lacks lawful authority to process;
  • facilitate criminal activity, unauthorized entry, or evasion of lawful security controls;
  • upload malicious code or intentionally distribute harmful or deceptive content.

4. Security and platform integrity

Customer may not:

  • attempt to access another customer’s account, data, tenant, site, storage, or administrative functions;
  • probe, scan, test, exploit, or bypass security controls except through a Nicholson Solutions-approved security review;
  • share administrative credentials with unauthorized persons or intentionally defeat account, site, licensing, rate, device, or access controls;
  • interfere with service performance through abusive automation, excessive requests, denial-of-service activity, or similar misuse;
  • reverse engineer or attempt to derive non-public source code or architecture except to the extent a restriction is prohibited by law.

5. Restricted data and biometric use

Unless Nicholson Solutions expressly approves the use in writing and required safeguards are implemented, Customer must not place or process complete payment-card data, Social Security numbers, unrelated account passwords, PHI requiring a business associate agreement, biometric templates or identifiers, or other specially regulated information in the services.

Ordinary photographs may be used for lawful operational purposes supported by the product. Customer must not use Nicholson Solutions services for facial-recognition templates, face-geometry analysis, fingerprints, voiceprints, or other biometric identification without separate written approval and required legal safeguards.

6. Minors

Customer must not enable children under 13 to directly register for Nicholson Solutions accounts or directly submit personal information through a child-directed Nicholson Solutions experience unless the applicable product has been specifically designed and legally reviewed for that purpose. Customer remains responsible for lawful handling of ordinary records about minors maintained as part of Customer’s operations.

7. No emergency-service reliance

Customer must not represent or use GuardReady Ops as a substitute for law enforcement, alarm monitoring, or emergency dispatch; CheknOps as a guarantee of physical access security; or DocGymOps as medical, legal, tax, financial, or emergency-health advice. Customer remains responsible for emergency procedures and human decision-making.

8. Intellectual property and competitive misuse

Customer may not copy, resell, sublicense, redistribute, remove proprietary notices from, or use Nicholson Solutions protected software expression, non-public workflows, designs, or architecture to create or assist a competing product except as expressly permitted in a signed writing.

9. Enforcement

Nicholson Solutions may investigate suspected violations and may restrict or suspend affected access when reasonably necessary to protect customers, users, systems, data, or legal compliance. When practical and risk permits, Nicholson Solutions will provide notice and a reasonable opportunity to correct a violation. Serious or intentional violations may result in immediate suspension or termination under the Agreement.

10. Reporting concerns

Security concerns, suspected misuse, or questions about permitted use may be sent to flight@nicholsonsolutions.net. Do not send passwords, complete payment-card numbers, or exploit code through ordinary email unless Nicholson Solutions provides a secure method.
